Terms of Use | Drivesona
Drivesona Legal

Terms built for an intelligent platform.

These Terms of Use govern your access to Drivesona websites, automotive intelligence tools, vehicle discovery experiences, VIN-level intelligence, dealer integrations, dashboards, communications, and related products and services.

Effective: September 29, 2026
Please read these Terms carefully. By accessing or using Drivesona, creating an account, submitting information, using a Drivesona-powered experience, or otherwise using the Services, you agree to these Terms to the extent permitted by applicable law.
Section 01

Agreement to These Terms

These Terms of Use (“Terms”) constitute an agreement between you and Drivesona regarding your use of the Drivesona websites, applications, interfaces, vehicle discovery experiences, dashboards, integrations, widgets, communications, and related services (collectively, the “Services”).

If you do not agree to these Terms, you should not access or use the Services.

Additional agreements may apply to dealerships, dealer groups, agencies, technology providers, enterprise customers, investors, or other business partners. If a separate written agreement conflicts with these Terms, the separate written agreement will control to the extent of the conflict.

Section 02

What Drivesona Provides

Drivesona provides automotive intelligence and vehicle-discovery technology designed to connect live dealership inventory with shopper intent, VIN-level context, AI-assisted discovery, on-site dealer experiences, behavioral intelligence, buyer-demand intelligence, attribution, analytics, and market intelligence.

Features may include inventory discovery guides, vehicle matching, VIN-level intelligence, comparison tools, shopper-intent analysis, dealership widgets, saved vehicles, analytics dashboards, referral detection, dealer handoffs, and related functionality.

Drivesona may add, remove, modify, test, suspend, or discontinue features at any time, subject to any applicable written agreement.

Section 03

Eligibility

You must be legally capable of entering into a binding agreement to use portions of the Services that require contractual consent.

If you use Drivesona on behalf of a dealership, dealer group, company, agency, or other organization, you represent that you have authority to bind that organization to these Terms or the applicable business agreement.

The Services are not intended for children under 13.

Section 04

Accounts & Access Credentials

Certain Services may require an account, login, or other credentials. You are responsible for keeping credentials confidential and for activities occurring through your account.

You agree to provide accurate information, maintain appropriate account security, and notify Drivesona if you believe credentials have been compromised or unauthorized access has occurred.

Drivesona may restrict, suspend, or revoke access if we reasonably believe an account is being misused, shared improperly, compromised, or used in violation of these Terms.

Section 05

Vehicle, Inventory & Pricing Information

Drivesona relies on information from dealerships, inventory feeds, manufacturers, data providers, public sources, and other systems. Inventory and vehicle information may change frequently.

Vehicle availability, pricing, mileage, condition, incentives, equipment, options, colors, specifications, fees, financing terms, warranties, and other details should be confirmed directly with the dealership before making a purchase decision.

A vehicle appearing in Drivesona does not guarantee that the vehicle is still available, that the displayed price is the final transaction price, or that every specification or attribute is error-free.

Drivesona is not the seller of dealership inventory unless expressly stated otherwise.

Section 06

AI, Matching & Vehicle Recommendations

Drivesona may use algorithms, semantic systems, machine learning, artificial intelligence, rules-based systems, and other technologies to interpret shopper requests, classify inventory, generate vehicle context, identify likely fit, summarize attributes, surface comparisons, or produce recommendations.

AI and automated systems can produce incomplete, outdated, inaccurate, ambiguous, or unexpected outputs. Users should independently evaluate material information before making a vehicle purchase, financing, leasing, safety, towing, payload, technical, or other significant decision.

Drivesona does not guarantee that any third-party AI platform, search engine, answer engine, or recommendation system will crawl, index, cite, rank, display, recommend, or otherwise surface any dealership, vehicle, page, or Drivesona experience.

Section 07

Dealerships & Business Partners

Drivesona may connect users with dealerships, dealer groups, agencies, website providers, marketplaces, automotive technology companies, OEMs, and other third parties.

Dealerships are responsible for their own inventory, pricing, advertisements, offers, sales practices, financing, leasing, warranties, customer communications, regulatory compliance, and fulfillment of transactions.

Unless expressly agreed otherwise in writing, Drivesona is not a party to a transaction between a shopper and dealership.

Partner Responsibilities

Business customers and partners are responsible for ensuring that information they provide to Drivesona is accurate, lawfully obtained, and authorized for the intended use.

Partners must obtain any legally required permissions, notices, or consents for personal information, marketing communications, cookies, tracking, text messaging, and data integrations that they initiate or control.

Section 08

Email, Telephone & Text Communications

If you provide contact information and request communications, you authorize Drivesona or the specifically identified dealership or partner to contact you as described at the point of collection.

Text Messaging

If you expressly opt in to SMS or MMS communications, you consent to receive messages from the identified sender at the number provided, including through automated technology where permitted by law.

  • Consent is not a condition of purchase.
  • Message frequency may vary.
  • Message and data rates may apply.
  • You may revoke consent at any time.
  • You may reply STOP to request that supported messages stop.
  • You may reply HELP for assistance where supported.

Consent to receive communications from one dealership, partner, or sender does not automatically constitute consent to receive marketing communications from unrelated senders.

Section 09

Acceptable Use

You may not misuse the Services or interfere with their normal operation.

Without limitation, you may not:

  • access the Services in violation of law;
  • attempt to gain unauthorized access to systems, accounts, or data;
  • probe, scan, or test vulnerabilities without authorization;
  • introduce malware, malicious code, or harmful automation;
  • scrape, crawl, harvest, or extract data at scale without authorization;
  • circumvent technical, access, rate, or security controls;
  • reverse engineer protected portions of the Services except where legally permitted;
  • impersonate another person or organization;
  • submit false, deceptive, fraudulent, or unlawful information;
  • use Drivesona to send unlawful marketing or communications;
  • resell or commercially exploit the Services except as authorized in writing;
  • use the Services to build or train a competing product using protected Drivesona data or output where prohibited by law or agreement; or
  • interfere with the rights or experience of other users, dealerships, or partners.
Section 10

User-Provided Content & Feedback

You may provide information, prompts, preferences, inquiries, comments, suggestions, feedback, or other content through the Services.

You represent that you have the right to provide that content and that its use as contemplated by the Services will not violate applicable law or third-party rights.

You retain ownership of content you own, but grant Drivesona a nonexclusive, worldwide, royalty-free license to host, process, reproduce, transform, display, transmit, and otherwise use that content as reasonably necessary to provide, secure, analyze, and improve the Services.

If you voluntarily provide product ideas, suggestions, or feedback, Drivesona may use that feedback without restriction or compensation unless otherwise agreed in writing.

Section 11

Intellectual Property

Drivesona and its licensors retain all rights in the Services, including software, source code, object code, algorithms, semantic systems, databases, workflows, designs, interfaces, text, graphics, branding, trademarks, logos, analytics, models, proprietary methodologies, and other protected materials.

Except for rights expressly granted under these Terms or a separate written agreement, no license or ownership interest is transferred to you.

“Drivesona” and associated names, designs, logos, slogans, and branding may not be used without authorization.

Section 12

Third-Party Websites & Services

The Services may link to or integrate with dealership websites, inventory providers, mapping services, analytics providers, communications platforms, AI services, social media, financing tools, and other third-party products.

Drivesona does not control third-party services and is not responsible for their availability, terms, privacy practices, security, accuracy, content, or performance.

Your use of third-party services may be subject to separate terms and privacy policies.

Section 13

Fees, Subscriptions & Commercial Services

Certain Drivesona services are offered to dealerships, dealer groups, partners, or enterprise customers for a fee.

Pricing, payment terms, implementation terms, renewal provisions, cancellation rights, service levels, and other commercial terms may be governed by an order form, proposal, subscription agreement, statement of work, or other written agreement.

Published pricing may change prospectively. Existing contractual commitments will be governed by their applicable agreement.

Section 14

Availability, Changes & Service Interruptions

Drivesona does not guarantee uninterrupted, error-free, or continuously available access to the Services.

Services may be unavailable because of maintenance, software updates, inventory-feed issues, third-party outages, security events, infrastructure failures, network conditions, changes in external platforms, or circumstances beyond Drivesona’s control.

Drivesona may modify or discontinue features, integrations, pages, outputs, or technologies as the platform evolves.

Section 15

Disclaimer of Warranties

To the maximum extent permitted by law, Drivesona disclaims implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, reliability, availability, and any warranties arising from course of dealing or usage of trade.

Drivesona does not warrant that:

  • the Services will always be available or error-free;
  • vehicle or inventory information will always be complete or current;
  • AI or automated outputs will always be accurate;
  • a particular vehicle will meet a shopper’s needs;
  • any dealership will honor a particular price, incentive, or representation;
  • use of Drivesona will generate leads, sales, traffic, rankings, citations, or revenue;
  • an AI platform or search engine will surface particular content; or
  • third-party systems or integrations will continue operating without change.
Section 16

Limitation of Liability

To the maximum extent permitted by applicable law, Drivesona and its owners, officers, employees, contractors, affiliates, licensors, service providers, and partners will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising from or related to the Services.

This includes, without limitation, loss of profits, revenue, goodwill, data, business opportunity, sales, customers, or anticipated savings.

To the maximum extent permitted by applicable law, Drivesona’s aggregate liability arising from or related to use of consumer-facing Services will not exceed the greater of: (a) amounts you personally paid to Drivesona for the applicable consumer Service during the 12 months preceding the event giving rise to the claim, or (b) one hundred U.S. dollars ($100).

Liability relating to a paid business customer or partner may instead be governed by the applicable commercial agreement.

Some jurisdictions do not allow certain limitations or exclusions, so portions of this section may not apply to you.

Section 17

Indemnification

To the extent permitted by law, if you use the Services on behalf of a business or commercial organization, you agree to defend, indemnify, and hold harmless Drivesona and its affiliates, officers, employees, contractors, and service providers from claims, damages, liabilities, losses, costs, and expenses arising from:

  • your violation of these Terms;
  • your misuse of the Services;
  • content or data you provide;
  • your violation of applicable law;
  • your violation of third-party rights; or
  • communications, marketing, or data-processing activity you initiate through the Services.
Section 18

Suspension & Termination

Drivesona may suspend or terminate access to the Services where reasonably necessary to protect security, enforce these Terms, prevent misuse, comply with law, address nonpayment, or protect Drivesona, users, dealerships, or partners.

Commercial customer termination and cancellation rights may be governed by a separate written agreement.

Sections that by their nature should survive termination, including intellectual-property protections, disclaimers, liability limitations, indemnification, and dispute provisions, will survive termination.

Section 19

Governing Law & Dispute Resolution

Unless a separate written agreement provides otherwise, these Terms will be governed by the laws of the State of New Jersey, without regard to conflict-of-law rules.

Informal Resolution First

Before filing a formal claim, you and Drivesona agree to make a good-faith effort to resolve the dispute informally. A written notice should describe the nature of the dispute and the requested resolution.

Notices may be sent to: colincarrasquillo@yahoo.com .

Arbitration and Class-Action Waiver

Important legal notice: If you decide to use a mandatory arbitration and class-action waiver provision, it should be reviewed by legal counsel and implemented with appropriate assent mechanics before publication. The language below is a draft framework only.

Except for claims eligible for small-claims court, requests for emergency injunctive relief, intellectual-property disputes, or matters that cannot legally be subject to arbitration, disputes arising out of or relating to these Terms or the Services may be resolved through binding individual arbitration if enforceable under applicable law.

To the extent legally enforceable, disputes must be brought on an individual basis and not as a plaintiff or class member in a purported class, collective, consolidated, or representative action.

If the arbitration provision is found unenforceable or does not apply, exclusive jurisdiction and venue for disputes will lie in the state or federal courts located in New Jersey, unless applicable law requires otherwise.

Section 20

Changes to These Terms

Drivesona may update these Terms from time to time as the platform, products, business model, legal requirements, or partnerships evolve.

Material changes may be accompanied by additional notice where appropriate.

The effective date at the top of this page indicates when these Terms were last updated.

Continued use of the Services after revised Terms become effective may constitute acceptance where permitted by law, but changes requiring affirmative consent will be handled separately.

Section 21

General Terms

Entire Agreement

These Terms, together with the Privacy Policy and any applicable written agreement, constitute the agreement governing your use of the Services.

Severability

If any provision is held invalid or unenforceable, the remaining provisions will remain in effect to the maximum extent permitted by law.

No Waiver

Failure by Drivesona to enforce a provision does not waive the right to enforce it later.

Assignment

You may not assign your rights under these Terms without Drivesona’s consent. Drivesona may assign these Terms in connection with a merger, acquisition, financing, reorganization, sale of assets, corporate restructuring, or transfer of the Services.

Force Majeure

Drivesona will not be responsible for failure or delay caused by circumstances beyond its reasonable control, including internet outages, third-party platform failures, natural disasters, labor disruptions, government actions, security incidents, infrastructure failures, or similar events.
